Condition
The following terms of service (these "Terms and
conditions") govern your access to and use of the Raeda website and mobile
application, and services offered on or through www.raedaexpress.com or the
Raeda mobile application
Raeda Express Ltd. and its subsidiaries are collectively referred hereto as
"Raeda" "we" or "us" and “you” or “user” means
you as a user of the Site.
Please read the Terms of Service carefully before you start
to use the Site. By using the Site, opening an account, or by clicking to accept
or agree to the Terms of Service when this option is made available to you, you
accept and agree, on behalf of yourself or your company or any other entity (if
applicable), to be bound and abide by these Terms and condition and Raeda
Express Payment Terms
If you do not want to agree to these Terms of Service or the
Privacy Policy, you must not access or use the Site. For more detailed policies
surrounding the activity and usage on the Site, please access the designated
articles herein.
This contains
details of how we run our operation and make timely deliveries at RAEDA
EXPRESS. Tracking code, shipping documents will be issued as a waybill and
will be issued alongside every package shipped.
Definitions:
In these conditions, the following expression
shall have the meaning respectively assigned to them, namely:
(a)
Sender or shipper shall mean the person
contracting with carrier for the carriage of Parcel document;
(b)
Carriage means transportation by air, land or
air or any other means
(c)
Mail, Parcel or Waybill means anything carried or to be carried under
these conditions; and
(d)
Courier means courier. Its staff, agent
subcontractor/successive carriers, and all authorized persons acting on their/our
behalf.
1.
Services restrictions:
(a)
If any Parcel to be carried in contravention of
these conditions, the carriage, therefore, may be returned and the Parcel may if
the carrier deems it necessary to be returned to the sender thereof or forward to
its destruction at the expense of the additional expenses of the sender.
(b)
No dangerous offensive or poisonous or
deleterious Parcel will be carried only if the sender warrants that the Parcel
is safe to be carried by air, land, or sea thus guaranteeing its safety throughout the carriage.
(c)
Carrier reserves the right to examine and
inspect the content of all Parcel but shall no under obligation do so. The sender must describe the Parcel on the consignment note.
(d)
Carrier reserves the right to abandon carriage
of a shipment at any time after acceptance when such shipment could cause damage or delay to other shipment or personnel or the carriage which is
prohibited by law or its in violation of all rules contained herein without
liability to the shipper.
2.
Limitation of liability
Subject to section 4 hereof the
carrier will be responsible only while the Parcel is within the carrier`s
custody and control shall be liable for loss sustained by shipper due to damage
or loss of the package.
(a)
Compensation of 35% of acceptable markets cost
of the delivery and deduction of 40% administrative cost, if the value is not declared.
(b)
The amount of any loss or damage to Parcel sustained must confirm the (1)below without regards to its commercial
or special value to the sender
(c)
The Actual value of a Parcel shall determine by
reference to our cost preparation, reconstitution, or values at the time and
place of the delivery.
3.
Liability not as assumed:
(a)
While the carrier will endeavor to exercise the
best efforts to provide fast delivery following regular delivery
schedules, the carrier will under NO CIRCUMSTANCE TO ANY OTHER PERSON FOR DELAY
IN PICK-UP, TRANSPORTATION OR DELIVERY OF ANY DELIVERY REGARDLESS OF THE CAUSE
OF SUCH DELAY.
(b)
The carrier shall not be reliable for any
damages delay, loss of an improper delivery, or undelivered (hereafter referred to
collectively in this condition as damage caused by :
(i)
The act default or omission of the sender,
receiver, or any other party who claims an interest in the delivery.
(ii)
The nature of the delivery or any defect
characteristic or inherent vices, therefore.
(iii)
Violation by the sender or receiver of any
condition stated herein including, but not limited to improper or insufficient
packing securing, making or addressing wrong descriptions of the content of any delivery, or failure to observe any of the rules relating to the shipment not acceptable
for transportation whether such rules are now hereby made known to the sender.
(iv)
The sender is liable for demurrage upon failure to
collect delivery within (3) days of the rate of N100.00 per package per day.
(v)
Compliance with the law, government regulation act
of commission of postal custom or another government official, riot, strikes, or
other act of God force majeure. Occurrence’s perils of the air weather
condition temperature attitude mechanical another delay of amount employ in the
transportation service or any cause beyond the carrier’s control.
(vi)
Forwarded, to whom a shipment is tempered by the
carrier for transportation to any location not regularly served by carrier
regardless of whether the sender requested or had knowledge of such third party
delivery arrangement.
(vii)
Property contained therein and the sender and
receiver whose property which property shall cause damage or to or destruction
of another consignment to the property or carrier shall indemnify carrier for
all the loss and expenses, incurred by the carrier as a result thereof.
(viii)
The sender shall be liable for all the damages
or loss suffered by the carrier or any other person by the reason of irregularity
incorrectness or incompletion of any description, statement, or particular
which the sender describes or attributes to the Parcel or receiver.
4.
Undeliverable packages:
(a)
Parcel shall be obliged to inquire into the
corrections or sufficiency of information furnished.
(b)
Consignment which is through no fault of the carrier, cannot be delivered on the first tender of delivery to the receiver
will return to the carrier's terminal.
The future tender will be made upon request of
the sender, in this regard, the full tariff will be paid.
5.
Claims
(a)
Receipt by the person to deliver the Parcel
without complaint is prime factor evidence that the package has been delivered in
good condition and accordance with the contract of carriage.
(b)
No action shall be maintained in the case of
damage to or partial loss of Parcel unless a written sufficiently describing
the package concerned the appropriate date of the damage and detail of the
claim is to be reported to the office of the carrier nearest to the location
which the package was accepted by the carrier within (7) days from the date of
receiving thereof in case of delay unless presented (14) day from the day the Parcel
is placed at the disposal of the person entitled to the delivery and in case
of loss (including non-delivery unless presented within (30) days from the date
of receipt by the courier).
(c)
NOTWITHSTANDING ANY OF THE FOREGOING, no claims
for loss or damage will be entertained, if the transaction charge has not been
paid. THE CUSTOMER HEREBY WAIVES ANY AND ALL RIGHTS INCLUDING ANY STATUTORY OR
COMMON LAW TO SET ALL OF THE AMOUNT OF ANY SUCH CLAIM AGAINST THE CARRIER.
6.
Consequential damages excluded:
Carrier shall not be liable in any
event for any inconsequential damages arising from carriage subject to the term
as cumbering whether for which carrier had no idea that such damage could occur.
7.
Lien on goods shipped:
All Parcel and documents relating to Parcel
shall be subject to the carrier’s right of determination to make dues in
respect of such Parcels and Parcel may be kept until the debt is recovered.
8.
Insurance
the carrier shall non the request of the
sender and upon payment for declared values thereof, at the prevailing rates,
arrange insurance coverage on behalf of the sender in amount to be determined
by the carrier
9.
Payment On Delivery: we do not accept any payment
on delivery after delivery, all payments should be made before shipment,
booking made via any means has a corresponding payment process
10.
Same-day delivery: all same-day delivery requests will be delivered
according to the standard delivery process
11.
Payment via bank transfer: If the customer selects this payment method,
the order will not be confirmed immediately and will only be confirmed once
payment via bank transfer, according to RADEA EXPRESS policy no rider is
permitted to receive cash payment during from any customer during delivery
