Terms of service are the legal agreements between a service
provider and a person who wants to use that service. The person must agree to
abide by the terms of service in order to use the offered service. Terms of
service can also be merely a disclaimer, especially regarding the use of RAEDA
EXPRESS. Terms and conditions are the contract foundation between you and your
customer. This contain details of how we run our operation and make timely
deliveries at RAEDA EXPRESS. Tracking code, barcode or consignment papers will
be issued as a waybill, and will be issued alongside every package shipped for
efficient customer’s documentation
Customs
Policies and Dues
Custom policies are configuration files that define the
behavior of your Active Directory Business to customer. Custom created a policy
that makes packages get to its destination with immediate effect
RAEDA EXPRESS will discharge any of the following activities
on Sender’s or Receiver’s behalf in order to carry out its designate services:
® Fill the
necessary documents, inspect product and pay any duties, taxes or extra charges
evidently required under THE FEDRAL REPUBLIC OF NIGERIA applicable laws and
regulations (“Customs Duties”), Act as Sender’s forwarding agent for customs
duties and export control purposes and as Receiver solely for the purpose of
designating a customs broker to perform customs clearance and entry.
Rejectable Shipping’s
A package is tagged unacceptable if:
Global Routes
In case that the route selected by the customer includes a
country that is not, at the moment of placing the order, a member of the
European Union, the customer is aware and agrees to the following:
The shipper is responsible to provide the original or a copy
of the original commercial invoice or any other document required by the
courier company and/or by the customs authorities. If any customs authority
requires additional documentation for confirming the import/export declaration,
it is the shipper’s responsibility to provide the required documentation at its
own expense.
The original or the copy of the original commercial invoice
should not include VAT on the price breakdown.
The courier may reject the collection or even return the
parcels to the shipper, applying extra costs for which the customer is solely
responsible, in case that the documentation required is not provided or are not
according to the regulations.
The shipper certifies that all statements and information
provided relating to the exportation and importation of the shipment will be
true and correct and acknowledges that if untrue or fraudulent statements about
the shipment or any of its contents are made, a civil claim and/or criminal prosecution
the penalties for which include forfeiture and sale of the shipment could
arise.
To the extent that we may voluntarily assist you in
completing the required customs and other formalities, such assistance will be
rendered at your sole risk. You agree to indemnify us and hold us harmless from
any claims that may be brought against us arising from the information you
provide to us and any costs we will incur regarding this and pay any
administration fee we may charge you for providing the services described in
this condition.
Any customs duties, taxes (including but not limited to VAT
if applicable), penalties, storage charges or other expenses RAEDA EXPRESS
incurs as a result of the actions of customs or other governmental authorities
or the shipper’s or receiver’s failure to provide proper documentation will be
charged to the customer or the receiver of the shipment. If RAEDA EXPRESS
decides to charge the receiver and the receiver refuses to pay the incurred
charges, the customer agrees to pay them to us together with our fee for the
administration involved as well as any extra costs we will incur.
The shipper confirms that the contents of the shipment are
not restricted by IATA, ICAO, IMDG, or ADR and are not prohibited items, and,
in case that they are, the customer is obliged to advise Raeda Express before
the collection.
The courier may reject a collection in case that the service
cannot be provided for any reason which is out of RADEA EXPRESS control such as
remote locations or sanctions imposed on the pickup country (embargo).
We will endeavor to expedite all customs clearance
formalities for your shipment but are not liable for any delays, losses, or
damage caused by interference from customs officers or other governmental
authorities.
Acceptable
and Unacceptable Deliveries
Delivery information’s are incomplete if delivery address
is a post office boxes or postal codes, package will not be accepted at RAEDA
EXPRESS. Packages are delivered to the Receiver’s address given by originator. Deliveries
to addresses with a central receiving area will be delivered to that area and
our nearest branch picks it up for timely deliveries.
RAEDA EXPRESS will notify Receiver of an approaching
delivery or impending delivery. Receiver will be presented other alternative
delivery options or till another day, deflect or collection at a RAEDA EXPRESS
Service Point.
If the package is labeled to be unacceptable as written
in Section 2, or it has been undervalued for customs purposes, or Receiver
cannot be reasonably identified or located, or Receiver refuses delivery or to
pay Customs Duties or other delivery charges, RAEDA EXPRESS shall use
reasonable efforts to return the package to Shipper at all cost, failing which
the package may be released, disposed of or sold without incurring any
liability whatsoever to Shipper or anyone else, with the proceeds applied
against Customs Duties, Shipment charges and related administrative costs with
the balance of the proceeds of a sale to be returned to Shipper. RAEDA EXPRESS
shall have the right to destroy any Dangerous Goods.
Raeda
Express Liability
1. RAEDA EXPRESS’s liability in respect of any one package
transported by air (including ancillary road transport or stops en route) is
limited by the Montreal Convention or the Warsaw Convention as applicable, or
in the absence of such Convention, to the lower of (i) the current market or
declared value, or (ii) 22 Special Drawing Rights per kilogram (approximately
$US 30.00 per kilogram). Such limits shall also apply to all other forms of
transportation, except where Shipments are carried only by road, when the
limits below apply.
For cross border Shipments transported by road, RAEDA
EXPRESS’s liability is or shall be deemed to be limited by the Convention for
the International Carriage of Goods by Road (CMR) to the lower of (i) current
market value or declared value, or (ii) 8.33 Special Drawing Rights per
kilogram (approximately $US 11.00 per kilogram). Such limits will also apply to
national road transportation in the absence of any mandatory or lower liability
limits in the applicable national transport law.
If Shipper regards these limits as insufficient it must make
a special declaration of value and request insurance as described in Section 8
or make its own insurance arrangements.
RAEDA EXPRESS’s liability is strictly limited to direct loss
and damage to a Shipment only and to the per kilogram limits in this Section 6.
All other types of loss or damage are excluded (including but not limited to
lost profits, income, interest, future business), whether such loss or damage
is special or indirect, and even if the risk of such loss or damage was brought
to RAEDA EXPRESS’s attention.
2. RAEDA EXPRESS will make every reasonable effort to
deliver the Shipment according to regular delivery schedules, but these
schedules are not binding and do not form part of the contract. RAEDA EXPRESS
is not liable for any damages or loss caused by delay, but for certain
Shipments, Shipper may be able to claim limited delay compensation under the Money
Back Guarantee terms and conditions.
Package
payment and prices
RAEDA EXPRESS’s delivery charges are calculated according to
distance or volumetric weight per piece and any piece may be re-weighed and
re-measured by RAEDA EXPRESS to confirm this calculation.
Sender, or the Receiver when RAEDA EXPRESS acts on
Receiver’s behalf, shall pay or compensate RAEDA EXPRESS for all Shipment or
other charges due, or Customs Duties owed for services provided by RAEDA
EXPRESS or incurred by RAEDA EXPRESS on Shipper’s or Receiver’s behalf. Payment
of Customs Duties may be requested prior to delivery.
If RAEDA EXPRESS uses its credit with the Customs
Authorities or advances any Customs Duties on behalf of a Receiver who does not
have an account with RAEDA EXPRESS, RAEDA EXPRESS shall be entitled to assess a
fee.
Affirmation
All claims must be submitted in writing to RAEDA EXPRESS within
thirty (30) days from the date that RAEDA EXPRESS accepted the Shipment,
failing which RAEDA EXPRESS shall have no liability whatsoever. Claims are
limited to one claim per Shipment, settlement of which will be full and final
settlement for all loss or damage in connection therewith.
Security/indemnity
may be able to arrange insurance covering the value in respect
of loss of or damage to the Shipment, provided that the sender so instructs RAEDA
EXPRESS in writing, including by completing the insurance section on the front
of the waybill or by RAEDA EXPRESS’s designated systems and pays the applicable
premium. Shipment insurance does not cover indirect loss or damage, or loss or
damage caused by delays.
Payment
options
All payment transactions processed through our website are secured, which ensures that communications between the user’s server and our website are encrypted and secure.

Payment via
bank transfer
If the customer opts for this payment method, the order will
not be confirmed immediately and will only be confirmed once Payment via bank
transfer, according to RADEA EXPRESS policy no rider is permitted to receive
cash payment during from any customer during delivery
Cancellations
in case of pricing changes
RAEDA EXPRESS reserves the right to charge the customer in
case that there is an abrupt change of pricing for the route selected by the
customer at the moment of placing the order, before obtaining authorization
from the customer for this extra charge. In case that the customer refuses the
extra charge for the change of pricing in the selected route, RAEDA EXPRESS
reserves the right to offer to the customer a full refund and do not forward
the order for transportation services to any courier company.
Services
Regulation
Shipper agrees to all routing and diversion, including the esibility
that the Shipment may be carried via intermediate stopping places.
